Terms of Use

These Terms of Use ("Terms") govern your access to and use of the KeyCase platform and services ("Service") provided by Tharass, a company incorporated under Dutch law with its registered office in the Netherlands ("Tharass", "we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service.

By creating an account or using our Service, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind such entity to these Terms.

KeyCase is a visual QA automation platform that enables teams to design, organize, and run test flows using reusable steps. The Service includes web-based applications, APIs, and related documentation.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You agree not to use the Service to: (a) violate any applicable laws or regulations; (b) infringe upon the rights of others; (c) distribute malware, viruses, or other harmful code; (d) engage in any activity that could harm or interfere with the Service; (e) attempt to gain unauthorized access to our systems or other users' accounts.

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these Terms.

The Service and its original content, features, and functionality are owned by Tharass and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you create using the Service. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of providing the Service.

Certain features of the Service may require payment. Prices are listed in Euros (EUR) and are exclusive of applicable taxes unless otherwise stated.

Payments are processed securely through third-party payment processors. We do not store your payment card information.

Subscription fees are billed in advance and are non-refundable except as required by applicable law.

We process your personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws. Please review our Privacy Policy for detailed information about how we collect, use, and protect your data.

As a data controller, we implement appropriate technical and organizational measures to ensure the security of your personal data.

To the maximum extent permitted by Dutch law, Tharass shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption.

Our total liability for any claims arising from or related to the Service shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.

You agree to indemnify and hold harmless Tharass, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

Either party may terminate these Terms at any time. Upon termination, your right to use the Service will cease immediately.

We may terminate your account immediately if you violate these Terms. In case of termination for cause, you will not be entitled to any refund of prepaid fees.

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands.

If you are a consumer resident in the European Union, you have certain rights under EU consumer protection laws, including the right to withdraw from distance contracts within 14 days.

Nothing in these Terms affects your statutory rights as a consumer under applicable EU or national law.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by email or through the Service.

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
